These Terms apply to your use of the NAKEKO website (the "Website") and any purchase you make from us. NAKEKO is operated by Nakeko Pty Ltd (ABN 59 667 510 901) ("NAKEKO", "we", "us", "our"). By using the Website or placing an order, you agree to these Terms.
1) Eligibility
By using this Website, you confirm that you are at least 18 years old, or that you are using it with the involvement and permission of a parent or guardian, and that you have the legal capacity to enter into a binding contract.
2) Use of the Website
You must use the Website lawfully and in accordance with these Terms. You must not (or attempt to):
• interfere with, disrupt, damage, or gain unauthorised access to the Website, servers, or security features
• use bots, scraping tools, or data extraction methods on the Website
• post unlawful, offensive, or misleading content, including reviews
• link to or use the Website in a way that misrepresents an affiliation with NAKEKO or harms our reputation
We may suspend or restrict your access if we reasonably believe you have breached these Terms.
3) Product Information & Availability
We aim to display product descriptions, sizing, pricing, and availability accurately. However:
• colours may differ depending on your device or screen
• size guides are a general guide only, and fit can vary between styles
• stock availability may change without notice
• we may correct errors (including pricing or availability errors) at any time
We may withdraw, update, or amend products and content without notice.
4) Pricing, Currency & Taxes
Prices are shown in Australian dollars (AUD) unless stated otherwise. Prices for orders delivered within Australia include GST.
If prices are displayed in another currency, this is a conversion for convenience only. The final amount charged may vary depending on your bank or card provider's exchange rate and fees.
International duties & taxes: Depending on your destination country, you may be required to pay duties, taxes, or other import fees set by local customs authorities. Unless stated otherwise at checkout, these charges are not included in your order total and are the responsibility of the customer. Please contact your local customs office for more information. If a parcel is refused or returned because these charges are unpaid, we may deduct the original and return shipping costs from any refund.
5) Orders & Contract Formation
When you place an order, you are making an offer to purchase products from NAKEKO.
• You will receive an order confirmation email after placing your order. This confirms we have received your order, but does not mean your order has been accepted.
• A binding contract is formed when we send you a shipping confirmation (or otherwise confirm dispatch).
We may refuse or cancel an order, including where:
• an item is out of stock or unavailable
• we identify a pricing or product description error
• payment cannot be processed or is suspected to be fraudulent
• we reasonably suspect the purchase is for resale or misuse
• delivery cannot be made to the address provided
If we cancel your order before dispatch, we will refund all amounts paid to your original payment method.
Limited releases & early access: Some products are released in limited quantities or offered first to members of early-access programs such as the NAKEKO Founders Club. Early access does not guarantee availability, and we may limit the quantity of any product available per customer.
6) Payment
Payment must be made in full at checkout using the payment methods available on the Website. If your payment is declined or cannot be verified, your order may not be processed.
Afterpay: If you pay with Afterpay, your instalment arrangement is with Afterpay and is subject to its terms and eligibility checks. Any refund will be processed back through Afterpay.
7) Shipping & Delivery
We deliver to the destinations shown at checkout, using the address you provide. Shipping costs and estimated delivery timeframes are shown at checkout and in our Shipping & Returns policy.
Processing times: Orders require processing before dispatch. During launches, limited releases, or peak periods, processing may take longer.
Delivery estimates: Delivery dates are estimates only. We will dispatch your order within a reasonable time, but we are not liable for delays caused by delivery partners or events outside our reasonable control, except as required under the Australian Consumer Law.
Risk: Risk in the products passes to you on delivery.
Authority to leave (ATL): If you provide authority to leave, you accept responsibility for the parcel once it is marked as delivered to the nominated address or location.
8) Returns & Refunds
Your consumer rights: Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
Faulty items: If your item is faulty, damaged, or not as described, please contact us at info@nakeko.com with your order number and photos. Normal wear and tear from training, misuse, or not following the care instructions is not considered a fault.
Change of mind: We offer change-of-mind returns in line with our Shipping & Returns policy (published on the Website). Returned items must be unworn, unwashed, and in original condition with tags and packaging attached. Return shipping costs for change-of-mind returns, including international returns, are the responsibility of the customer.
Final sale: Items marked Final Sale (or similar) may have different change-of-mind conditions, which will be stated on the product page or at checkout. This does not affect your rights for faulty items.
9) Promotions & Early Access
From time to time, we may run promotions, member offers, or early-access releases. Unless stated otherwise:
• offers are available while stocks last and may be withdrawn or extended at any time
• offers cannot be combined with other offers unless specified
• we are not obliged to honour an offer outside its stated timeframe
• we may exclude certain products from an offer
10) Gift Cards & Store Credit
If NAKEKO issues gift cards or store credit:
• gift cards are valid for at least three years from the date of purchase, as required by Australian law, or longer if stated at issue
• they are not redeemable for cash, except where required by law
• they should be treated like cash and may not be replaced if lost or stolen
11) Reviews & Your Content
If you submit a review, photo, or other content to us, you confirm it is your own, accurate, and not unlawful. You grant NAKEKO a non-exclusive, royalty-free licence to use, display, and reproduce that content in connection with NAKEKO. We will ask your permission before featuring content you have tagged us in on social media.
12) Intellectual Property
All content on this Website (including the NAKEKO name, logos, artwork, text, images, video, garment designs, and branding) is owned by or licensed to NAKEKO and is protected by intellectual property laws.
You must not reproduce, distribute, modify, or use our content for commercial purposes without our written consent.
13) Product Use
NAKEKO apparel is designed for training and everyday wear. It is not protective equipment. Combat sports carry an inherent risk of injury, and you are responsible for training safely. Please follow the care instructions on each product to maintain its fit and performance.
14) Limitation of Liability
Nothing in these Terms excludes, restricts, or modifies any right or remedy you have under the Australian Consumer Law or other laws that cannot be excluded.
Subject to that, and to the maximum extent permitted by law:
• NAKEKO is not liable for indirect or consequential loss (including loss of profit or opportunity) arising from your use of the Website or purchase of products
• our total liability for any claim relating to an order is limited to the amount paid for the relevant product(s)
15) Privacy
Our collection and use of personal information is governed by our Privacy Policy, available on the Website.
16) Changes to These Terms
We may update these Terms from time to time. The current version will always be published on the Website. Changes will not apply to orders placed before the updated Terms were published.
17) Governing Law
These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of Victoria.
